TrekMap Terms of Service

Effective date: October 1, 2026 Version: 2026-09-v2.0

Please read these two things carefully.
Section 23 requires most disputes to be resolved by individual arbitration instead of a court or class action. You can opt out within 30 days.
Section 7 explains that TrekMap's AI features can be wrong. Check anything that matters — especially entry requirements, safety, prices and opening hours — with official sources before you rely on it.

#1. About these Terms

These Terms of Service ("Terms") are an agreement between you and Soluvo LLC, a Florida limited liability company doing business as TrekMap ("TrekMap," "we," "us," "our"). They cover your use of the TrekMap website (trekmap.co), our iOS and Android apps, TrekMap hardware devices and their software, our emails, and our shop and waitlist (together, the "Services").

These documents are part of these Terms:

By checking the box at sign-up, or by using the Services, you agree to these Terms. If you don't agree, don't use TrekMap.

#2. Who can use TrekMap

You must be at least 18 years old to create an account or use the Services. By using TrekMap you confirm that you are, that you can enter into this agreement, and that you aren't barred from using the Services under applicable law. We ask for your month and year of birth when you sign up, and where the law requires it we may check age information provided by the app store.

We may refuse, suspend or terminate accounts we believe belong to someone under 18.

#3. Your account

Give accurate information and keep it up to date.
You're responsible for what happens in your account. Keep your sign-in secure, and tell us at support@trekmap.co right away if you think someone else has access.
One account per person. Don't share your account or transfer it to anyone else.
Don't pick a username that impersonates someone, infringes a trademark, or breaks our Community Guidelines. We may reclaim usernames.
Some accounts are operated by TrekMap (for example the official TrekMap account that publishes curated places).

#4. Your licence to use TrekMap

Subject to these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the TrekMap apps on devices you own or control, and to use the Services, for your own personal, non-commercial use. If you downloaded an app from an app store, that store's usage rules also apply.

You may not, and may not let anyone else:

copy, modify, translate, or create derivative works of the Services or their software, except where the law says you may despite this restriction;
reverse engineer, decompile or disassemble the software, except to the extent the law expressly allows;
rent, lease, sell, sublicense, or use the Services to build a competing product;
use robots, scrapers, crawlers, or other automated means to access, collect or copy any part of the Services or other users' content;
get around rate limits, quotas, authentication, or other technical restrictions;
interfere with, overload or disrupt the Services, or probe or test their security without our written permission (report vulnerabilities to support@trekmap.co);
remove or obscure any notices in the Services.

The Services include open-source components, which are licensed under their own terms; those terms control where they conflict with this section. Apps may update automatically; some updates are required for the Services to keep working.

TrekMap hardware devices come with firmware that is licensed, not sold, under this section and any terms supplied with the device.

#5. Your content and the rights you give us

You keep ownership of your content — your photos, videos, pins, notes, journals, trips, messages, comments and anything else you add ("your content").

To run TrekMap, you give us a worldwide, non-exclusive, royalty-free licence to host, store, cache, back up, reproduce, adapt (for example resize, compress, crop, convert formats, translate, or strip metadata), publish, publicly display and distribute your content, and to create derivative works such as maps, trip stories, share cards and AI-generated summaries — only to operate, provide, secure and improve the Services, and only to the audience your privacy settings allow. You also let us sublicense these rights to the service providers listed in our Privacy Policy, for the same purposes.

This licence ends when you delete your content or your account, except that (a) copies other people already saved or shared stay with them, (b) copies may remain in backups for a limited time, and (c) we may keep content when the law or a legal claim requires it.

We won't use your photos, name or likeness in paid advertising for TrekMap outside the Services without asking you first.

You promise that:

you own your content or have the rights to post it, including any music, video or images from other people;
posting it doesn't break the law or anyone's rights — including privacy and publicity rights;
you have permission from anyone shown in photos you post publicly, and you won't post other people's home addresses, precise locations, or private information without their consent;
your content follows our Community Guidelines.

If you send us feedback or ideas, we can use them without obligation to you.

#6. Who sees your content

You choose whether your account is Public, Friends only, or Private, and you can set the audience for individual pins and trips. Content you make public can be seen by anyone, including people without a TrekMap account, and may appear in search engines. People who can see your content can copy, screenshot or share it — we can't control that, and we aren't responsible for what others do with content you've shared.

Think about location before you post. Photos and pins can reveal where you live, work or stay. Use Friends only, Private, or the approximate-location option for places you want to keep private.

#7. AI features

TrekMap uses artificial intelligence to find places in links, videos, photos, screenshots and articles you share; to rebuild trips from your photos; to write suggested notes and trip stories; and — when turned on — to suggest plans in a chat.

AI output can be wrong. It may put a place in the wrong country, invent details, mix up similar-looking locations, or rely on outdated information. Pins and stories created with AI are suggestions until you check them. You're responsible for reviewing AI output before saving, sharing or acting on it, and for anything you publish that came from AI.

TrekMap isn't a travel agent, guide, or professional adviser. Nothing the AI produces is legal, immigration, medical, financial or safety advice. Always confirm visa and entry requirements, local laws, safety conditions, prices, opening hours and accessibility with official sources before you travel.

You agree not to use AI features to produce content that breaks our Community Guidelines, to try to make them ignore their instructions or limits, or to extract other people's private information. We may limit AI usage per account, change the underlying providers, or turn features off.

The AI trip planner in chats is off until someone in the chat turns it on. If you turn it on, you're telling us the group is comfortable with the planner reading that chat's messages — so ask first. Everyone in the chat can see it's on, and anyone can turn it off.

As between you and us, you may use the AI output generated for you as part of your content, subject to these Terms. AI output isn't unique: the same or similar suggestions may be produced for other people.

#8. Flights, prices and travel information

TrekMap is not a travel agency, tour operator, airline, or seller of travel. We don't sell tickets, take bookings, or handle payments for travel.

Flight prices, award-seat availability, routes, visa and entry information, country facts, transit data and similar information come from third-party sources and from public websites. It can be incomplete, out of date, or wrong, and prices change constantly.
Deal ratings and alerts are informational only, not advice or an offer.
When you tap to book, you leave TrekMap for a third-party website. Any booking, payment, change, cancellation or refund is between you and that provider under their terms. We aren't responsible for their websites, prices, services or conduct.
Expense splitting and booking records in TrekMap are notes for your own use. TrekMap doesn't hold, transfer or process money between users. Settle up between yourselves.
Some travel links are affiliate links. If you book through one, we may earn a commission at no extra cost to you. This never changes the prices we show or the order in which we show them.

#9. Content from other platforms

TrekMap lets you save places from posts you find elsewhere — for example on Instagram, TikTok, YouTube or Pinterest.

Share only content you have the right to share, and use the feature the way those platforms allow.
TrekMap links back to the original post and credits the creator. Posts are displayed or played from the original platform; we don't claim ownership of them. If the creator deletes the post, makes it private, or removes access, it stops appearing in TrekMap.
If you're a creator and you want a pin that uses your content removed, contact contact@trekmap.co or use our Copyright Policy. We'll review the request and remove it.
TrekMap isn't affiliated with, sponsored by or endorsed by Instagram, Meta, TikTok, YouTube, Google, Pinterest, Apple, or any airline or booking site. Their names and logos belong to them.

Messages are stored on our servers and aren't end-to-end encrypted. We may access them in the limited situations described in the Privacy Policy.
We don't verify who our users are. We don't run background checks. Use your judgment before sharing locations or plans, joining a trip with someone, or meeting anyone in person, and meet in public places.
Interactions between users — including trips, expenses and travel plans — are between those users. We aren't a party to them and aren't responsible for them.
Don't use TrekMap to track, stalk or harass anyone, and don't use its location features to monitor someone without their knowledge.

#11. Community Guidelines and acceptable use

Our Community Guidelines and Acceptable Use Policy are part of these Terms. In short, don't post or do anything illegal, abusive, deceptive, infringing, sexually explicit, or dangerous; don't post other people's private information; don't spam, scrape, or manipulate the service; and don't use TrekMap to harm anyone — especially children.

#12. Moderation and enforcement

We may review content and activity, and we may remove or restrict content, hide content that several people report, limit features, or suspend or terminate accounts that break these Terms or the Community Guidelines, that create legal risk, or that harm other users.

We aren't obligated to monitor the Services, and nothing in these Terms is a promise that we will review, remove, or take any particular action on any content. We try to act on reports promptly, and we'll usually tell you if we remove your content or restrict your account, unless we're prevented from doing so or it would create a risk. You can appeal by emailing support@trekmap.co within 30 days.

#13. Copyright and other intellectual property

We respond to copyright notices and terminate repeat infringers as described in our Copyright and DMCA Policy.

The Services themselves — including software, design, text, graphics, the TrekMap name and logo, and curated content we create — belong to Soluvo LLC or our licensors and are protected by intellectual property laws. These Terms don't give you rights to our trademarks or branding. Place names, boundaries and map data come from sources like OpenStreetMap and Natural Earth and are used under their licences; map borders and labels are shown for navigation and reflect our data sources, not any political position.

#14. Third-party services and content

The Services include content and features provided by others — sign-in services, maps and place information, flight and travel data, images, and embedded posts. We don't control them and aren't responsible for them.

Some features use Google Maps Platform. By using them you agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. Map data from OpenStreetMap is © OpenStreetMap contributors and licensed under the Open Database License. Images from Wikimedia Commons and Openverse are used under their own licences, with attribution where required.

#15. Communications from us

By creating an account, you agree to receive electronic communications from us — account, security, transaction and legal notices — by email or in the app, and you agree that these satisfy any legal requirement that a notice be in writing. We'll also send product updates, our weekly digest and any alerts you turn on; you can opt out of those in Settings or with the unsubscribe link, but you can't opt out of essential account and legal notices while you have an account.

#16. TrekMap devices, reservations and Kickstarter

TrekMap devices (TrekMap Mini, TrekMap, TrekGlobe) are pre-production. Product images in our shop are concept renders, and specifications, pricing and timelines can change.
Joining the waitlist or "reserving" a device is not a purchase, creates no obligation for either of us, and doesn't charge you anything.
If you back TrekMap on Kickstarter, Kickstarter's terms govern your pledge, and the campaign page describes what you're backing. Backing a crowdfunding project carries risk, including delay or non-delivery.
When we sell devices directly, separate terms of sale (including warranty, shipping, returns and safety information) will apply.
TrekMap devices need a TrekMap account and an internet connection to sync. Features and cloud support for devices may change over time.

#17. Fees

The Services are currently free. If we add paid features or subscriptions, we'll describe the price and terms before you buy. Purchases made through the App Store or Google Play are also subject to that store's terms, and refunds are handled under that store's policies.

#18. Changes, beta features and availability

We're actively building TrekMap, so features change, and some are labeled beta or experimental — those may be unstable, change, or be removed. We may modify, suspend or discontinue any part of the Services; if we discontinue the Services entirely, we'll give reasonable notice and time to export your data. The Services may be unavailable at times, and we don't guarantee that your content will be stored without loss — keep your own copies of photos and anything important (Settings → Download my data).

#19. Ending this agreement

You can stop using TrekMap anytime and delete your account in Settings or at trekmap.co/delete-account.

We may suspend or terminate your access if you break these Terms or the Community Guidelines, if we're required to by law, if your account creates risk or legal exposure for us or others, or if we discontinue the Services. When your account ends, your licence to use the Services ends, and your content is handled as described in the Privacy Policy. Sections 5 (for content others have kept), 7, 8, 12–14, 20–23 and 26 survive termination.

#20. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We don't warrant that: the Services will be uninterrupted, secure or error-free; that locations, maps, prices, travel information, visa information or AI output will be accurate, complete or current; or that content will not be lost.

Travel involves risk. You're responsible for your own decisions and safety, including deciding whether a place is safe, legal or open to visit, and complying with entry rules and local laws.

Some states don't allow certain disclaimers, so parts of this section may not apply to you.

#21. Limitation of liability

To the fullest extent allowed by law:

Neither TrekMap nor its owners, employees, contractors or suppliers will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill, or for personal injury or property damage arising from travel you undertake, from another user's conduct, or from third-party content or services.
Our total liability for all claims relating to the Services is limited to the greater of US $100 or the amount you paid us in the 12 months before the event giving rise to the claim.

These limits apply even if a remedy fails its essential purpose, and they're part of the basis of our agreement. Nothing here limits liability that can't be limited under applicable law.

#22. Indemnification

To the extent allowed by law, you'll defend, indemnify and hold harmless Soluvo LLC and its owners, employees and contractors from claims, damages, losses and reasonable legal fees arising out of your content, your use of the Services, your violation of these Terms or the law, or your violation of anyone's rights. We may take control of the defense of any such claim, and you'll cooperate with us.

#23. Dispute resolution, arbitration and class-action waiver

Please read this section carefully. It affects how disputes between you and TrekMap are resolved, and it limits your right to go to court or take part in a class action.

#23.1 Talk to us first

Most problems can be sorted out quickly. Before starting a formal proceeding, send a written notice to contact@trekmap.co (or to the address in Section 27) describing the problem, what you want, your name, and the email on your account. We'll do the same for any claim we have against you. Both of us agree to try in good faith to resolve it for 60 days after that notice. This step is a requirement before arbitration, and the deadline for bringing a claim pauses while it runs.

#23.2 Agreement to arbitrate

If we can't resolve it, you and TrekMap agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, not in court, and not before a jury. This agreement is governed by the Federal Arbitration Act.

Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (and any AAA rules that apply to multiple or mass filings), available at adr.org.
Filing, administrative and arbitrator fees are paid as the AAA's consumer rules require, which generally means we pay most of them.
The arbitration is held by video or telephone, or in the county where you live, unless we agree otherwise.
The arbitrator can award the same individual relief a court could, and the decision is final and can be entered as a judgment.

Exceptions. Either of us may (a) bring an individual claim in small-claims court, and (b) go to court for an injunction or other equitable relief to stop unauthorized use of the Services, intellectual property infringement, or misuse of the Services that risks harm.

#23.3 No class actions

You and TrekMap each waive the right to bring or participate in a class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed by that party's claim. If a court decides this waiver is unenforceable for a particular claim, that claim must proceed in court under Section 26, and the rest of Section 23 still applies to every other claim.

#23.4 Many similar claims

If 25 or more similar arbitration demands are filed against us by or with the help of the same or coordinated counsel, the AAA's rules for multiple case filings apply. The demands will be handled in sequential batches of up to 50, each batch decided by one arbitrator, with fees for later batches due only as those batches begin. Deadlines for bringing claims are paused for demands waiting in a later batch. Either of us may ask a court to enforce this paragraph.

#23.5 Opting out of arbitration

You can opt out of Sections 23.2–23.4 by emailing contact@trekmap.co with the subject "Arbitration Opt-Out," or writing to the address in Section 27, within 30 days of first accepting these Terms. Include your name, username, and a statement that you're opting out. Opting out doesn't affect any other part of these Terms, and we won't hold it against you.

#23.6 Changes to this section

If we change Section 23, we'll give you notice at least 30 days before it takes effect and a way to reject the change. Changes don't apply to disputes we already know about.

#24. App store terms

#24.1 Apple

These terms apply when you use the TrekMap iOS app, and Apple Inc. is a third-party beneficiary of them and may enforce them against you:

Acknowledgement. These Terms are between you and Soluvo LLC only, not with Apple. Soluvo LLC, not Apple, is responsible for the app and its content.
Scope of licence. Your licence to use the app is the one in Section 4, limited to a non-transferable licence to use the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Maintenance and support. Soluvo LLC is solely responsible for maintenance and support. Apple has no obligation to provide any.
Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent allowed by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are Soluvo LLC's responsibility.
Product claims. Soluvo LLC, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
Intellectual property claims. If a third party claims the app infringes their intellectual property rights, Soluvo LLC, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
Legal compliance. You represent that you're not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you're not on any U.S. Government list of prohibited or restricted parties.
Developer name and address. Soluvo LLC, [Mailing address pending], support@trekmap.co — send any questions, complaints or claims about the app here.
Third-party terms. You must comply with applicable third-party terms when using the app.

#24.2 Google Play

If you got the app from Google Play, your use is also subject to Google Play's Terms of Service. Google isn't a party to these Terms and isn't responsible for the app.

#25. Export controls and sanctions

You may not use the Services in violation of U.S. export control or sanctions laws, and you confirm you aren't located in an embargoed country or on a restricted-party list.

#26. Other terms

Governing law and venue. These Terms and any dispute are governed by the laws of the State of Florida and, where it applies, the Federal Arbitration Act, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you and TrekMap agree to the exclusive jurisdiction of the state and federal courts located in Palm Beach County, Florida, and waive any objection to venue there. Nothing in this paragraph deprives you of consumer protections that the mandatory law of your home state gives you.
Changes to these Terms. We may update these Terms. For material changes we'll give at least 30 days' notice by email or in the app and ask you to accept the updated Terms; other changes take effect when posted. If you don't agree, stop using the Services and delete your account. Changes don't apply retroactively to a dispute we already know about.
Assignment. You can't assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
Severability and waiver. If any provision is unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it.
Entire agreement. These Terms, plus the documents listed in Section 1, are the entire agreement between you and TrekMap about the Services.
Force majeure. Neither of us is liable for delays or failures caused by events beyond reasonable control.
No third-party beneficiaries, except Apple as described in Section 24.1.
Language. These Terms are written in English. Any translation is for convenience, and the English version controls.
Relationship. These Terms don't create a partnership, employment or agency relationship.
Notices. We send notices to the email on your account or show them in the app. Send us legal notices at contact@trekmap.co and to the address in Section 27.
